3. Nature of Business & Quotations

Global Agro India is an international merchant exporter of agricultural commodities. Information, product descriptions, and price quotations provided on this website or via correspondence are invitations to treat. A binding contract is only formed when a formal Proforma Invoice (PI) or Sales Contract is issued by us and signed/acknowledged by both parties, accompanied by the agreed advance payment or Letter of Credit (L/C).

4. Quality, Specifications, and Inspections

All products are exported based on the mutually agreed technical specifications, grading, and parameters detailed in the Sales Contract.

Unless otherwise specified, quality inspections will be conducted at the port of loading in India by an independent, internationally recognized inspection agency (e.g., SGS, Geo-Chem) at the buyer's or seller’s expense as stipulated in the contract. This inspection report shall be deemed final and binding regarding quality and weight at loading.

5. Import Regulations and Compliance

The buyer is solely responsible for ensuring that the ordered agricultural products comply with the import laws, biosecurity measures, and phytosanitary regulations of the destination country. Global Agro India will provide standard export documentation (e.g., Phytosanitary Certificate, Certificate of Origin), but cannot be held liable if goods are detained, confiscated, or rejected by destination customs due to changing local import policies.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Global Agro India shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, loss of market, or business interruption arising from delays, shipping constraints, or force majeure events.

7. Force Majeure

Global Agro India shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to acts of God, war, government restrictions or export bans, crop failures, strikes, port congestions, pandemics, or shipping line cancellations.

8. Governing Law and Jurisdiction

These Terms and Conditions and all commercial transactions shall be governed by HA PROTECH. Any disputes arising out of or in connection with our services shall be subject to the exclusive jurisdiction of the courts in Thane/Mumbai, Maharashtra, India.
